APWU Reaches Monetary Settlement with USPS on POStPlan Staffing Violations

02/23/2018 - On February 9, the Clerk Craft reached a $49.9 million dollar settlement with the USPS on POStPlan staffing violations. The monetary settlement follows a ruling by Arbitrator Stephen Goldberg that the Postal Service violated Arbitrator Goldberg’s previous award of September 5, 2014 and a subsequent Memorandum of Understanding (MOU) dated September 22, 2014.

The dispute was initiated after the Postal Service admittedly failed to honor their agreement that after December 22, 2014, the ‘POStPlan’ Remotely-Managed Post Offices (RMPOs) open 4 or 6 hours a day would be staffed with bargaining unit clerks, and Level 18 offices would be staffed with career employees. Long after the agreement, Postmaster Reliefs (PMRs) were still working in 4 or 6 hour RMPOs across the country and Level 18 offices reported still using PSEs instead of career employees.

“Our goal is for management to abide by their contractual obligations in the first place. When they don’t, it is best if management addresses the problem as quickly as possible, in this case to properly staff the POStplan offices,” remarked President Dimondstein. “Unfortunately, neither happened, and I congratulate the Clerk Craft in insuring that these management violations have consequences as a deterrent to future violations.”

 

White House Budget for 2019 Continues Attacks on Postal and Federal Workers

02/21/2018 - The White House introduced its proposed Fiscal Year 2019 budget to Congress last week. This non-binding proposal begins an annual, months-long government funding process and also showcases the Administration’s funding priorities, setting the tone for budget negotiations.  

For postal and federal workers, this budget is largely a reintroduction of last year’s failed attacks on our pay and benefits, but takes them even further. It:

  • Increases employee FERS contributions 1% a year for each of the next six years;
  • Eliminates FERS Cost of Living Adjustment (COLA), and reduces CSRS COLAs by 0.5%;
  • Eliminates the special retirement supplement;
  • Reduces retirement benefits by using a “high five” salary average formula, rather than the current “high three” average;
  • Lowers the G-fund interest rate to provide worse returns on Thrift Savings Plan investments;
  • Increases the share postal and federal workers pay for care under the FEHBP;
  • Slashes Postal Service personnel costs and reduces mail service to the American people to achieve $44 billion dollars in postal-specific savings;
  • Decrease FECA compensation for injured workers and institute a new waiting period before they can receive benefits;
  • Cuts $237 billion from Medicare.

 

Working People’s Day of Action is Feb. 24 APWU Members Encouraged to Participate

02/17/2018 - On Saturday, Feb. 24, workers will gather from coast to coast for a Working People’s Day of Action to demand an end to the rigged economic system. They will to stand together to fight for social and economic justice including the right to fair bargaining and union representation!

The Day of Action, organized by AFSCME and Jobs with Justice, comes at a crucial time in labor movement history. It is part of the commemoration for the 50th anniversary of the historic Memphis Sanitation Workers Strike. The strike was sparked by the tragic deaths of Echol Cole and Robert Walker on Feb. 1, who were sheltering from a storm inside their truck when it malfunctioned, and crushed them. On February 12, 1968 the black sanitation workers went on strike to demand that their dignity, their humanity and their union be recognized.

 

First COLA Increase of 2018

02/16/2018 - In accordance with the 2015-2018 Collective Bargaining Agreement, career employees represented by the APWU will receive a 25 cent per hour cost-of-living adjustment (COLA), effective March 3. The increase is the result of a rise in the Consumer Price Index (CPI-W). It will appear in paychecks dated March 23, 2018 (Pay Period 06-2018), and will total $520.00 per year.

The COLAs are in addition to general wage increases.

This is the sixth cost-of-living increase under the 2015-2018 contract:

  • $0.00 The first COLA would have been effective Sept. 5, 2015
  • $0.00 The second COLA would have been effective March 5, 2016.
  • $21.00 The third COLA was effective Sept. 3, 2016.
  • $333.00 The fourth COLA was effective March 18, 2017.
  • $270.00 The fifth COLA increase effective Sept. 2, 2017.
  • $520.00 The sixth COLA effective March 3, 2018.

The COLAs received so-far during the 2015-2018 CBA will total $1,144 per year.

Postal Support Employees (PSEs) do not receive cost-of-living increases, but have five general wage increases under the 2015-2018 contract. On Nov. 25, 2017, PSEs received a pay increase of 2.3 percent and will receive a 21-cent raise on May 26, 2018.

Good afternoon folks,

 

Just a quick update regarding how the EAP critical incident stress management (CISM) response normally goes with such a significant incident and my discussions with Robin Doleno following yesterday's tragic events. Robin is with Magellan Health Inc. She is the new National Consultant Director for the USPS EAP. She has been with Magellan and been part of EAP for many years but assumed the national consultant position a few months ago.

 

Generally, in response to this type of critical incident we want to ensure EAP consultants and clinicians are promptly and visibly present and accessible to our members and coworkers who were either directly or indirectly impacted by the mass shooting. Personal responses will vary based on the degree of personal impact and may be elevated by past personal history.

 

So while I appreciate Jann efforts to be responsive by communicating with local and national APWU leaders and members of the cluster to disseminate information and brochures as needed, in situations as impactful and tragic as this, there should be an automatic assumption that services are needed.

 

As you know we have employees who were directly impacted, having children who attended the school, and at least one employee who lost his son.  Others will be impacted because they work with these employees, know of someone outside of work, perhaps a distant family member, friend or neighbor who was impacted on some level or impacted because this incident happened within our postal community, or in or near their neighborhood community.

 

Of course flyers, brochures and the referenced stand ups, I assume being given by management, can be helpful, but they alone, or in combination are frankly an inadequate response to a tragedy of this caliber. EAP professionals should be granted access to conduct stand ups and walk-arounds with the support of management and local leadership. It is insufficient for EAP information to merely be disseminated. The trained, licensed professionals need to be able to talk to employee groups about what reactions they may have had, what reactions may be yet to come and how to deal with them. They are the professionals - not management although I am confident they are well-intended in this instance.

 

The EAP should be granted time following the stand up to talk to individuals one on one if requested following the stand up. They should make prompt visits to as many offices in the impacted and nearby surrounding areas as possible. As of this morning plans only included visiting four offices (Pompano Beach, Coral Springs, Atlantis, and Coco Creek which in my opinion is also inadequate which is why I requested Robin to deploy other EAP consultants and clinicians from Tampa, Miami, Orlando to assist in conducting visits throughout the area. I have not received confirmation that this will transpire, as USPS HQ has to authorize but I am hopeful it is in the works. I will follow-up with Robin tonight or tomorrow. Jeff I have since contacted Robin about your concerns regarding Royal Palm. She should be in touch if she has not been already. There is too much ground to cover in a short time with only 1 consultant and 2 clinicians regularly based in SF.

 

I also requested EAP contact local leadership, specifically BCAL, Miami and Palm Beach Locals to provide a CISM consultation to our presidents or their designee. I have requested EAP to seek out an APWU steward in offices when they visit. I have requested EAP reach out to our NBA's in Tampa to keep you updated as you cover the members working and living in the impact area.

MVS New Hire Salary Dispute Settled

02/05/2018 - On Jan. 26, the MVS Division and the USPS settled Class Action Grievance USPS NO. Q15V-4Q-C17473798/APWU No. HQTV20170179.

In the settlement, the parties agreed that when an external posting to hire contains an incorrect salary for the position in question, the Postal Service may correct the error pre-employment. Correction of the error must be made prior to a written job offer being accepted by the applicant.

If an applicant accepts a written job offer which incorrectly lists a salary higher than the entry level for that position, the applicant will be placed in a salary which is on the appropriate Article 9 pay table, but not lower than the salary on the accepted job offer.

In various parts of the country, the USPS was recruiting and hiring PVS operators by offering to pay these new employees higher than the entry level salary for that position. This action is against every principle of Article 9 Salaries and Wages of the Collective Bargaining Agreement.

In some locations, management would then rescind the offer after the employee was hired and pay a lower rate. Often, the employee would receive a letter of demand for overpayment of their salary.

The parties agreed to resolve this issue with language that dictates once the USPS hires an employee with an improper salary, they are contractually obligated to pay that employee at the rate they agreed to upon hire.

“The APWU is pleased to resolve this issue and bring relief to the newly-hired drivers who left previous employment on the assumption that the USPS would abide by the accepted salary,” said MVS Director Michael O. Foster. “There are no authorized salary exceptions for career employees. Every employee should be hired and paid off of the Article 9 pay chart. Any letter of demand based on this issue can now be resolved using this settlement.”

We need a strong show of force and Solidarity on the 24th. We are planning FREE Bus transportation to & from the event in Miami but we need commitments from affiliates and members to determine the size of the bus.

The Miami Rally will be at Bayfront Park, 301 Biscayne Blvd. Miami, FL 33132 near the Torch of Freedom from 11:00 AM to 1:00 PM. The bus we will have to leave sometime around 9:00. Exact time will have to be determined later. We are planning to stage the bus at the IBEW 728 Hall at 4620 Summit Blvd. West Palm Beach, FL 33415. More details will follow as available.
